What is California’s Safe Drinking Water and Toxic Enforcement Act (Proposition 65)?

California’s Safe Drinking Water and Toxic Enforcement Action – commonly known as Proposition 65 or “Prop 65” – is a California law that was enacted by California voters in 1986. It requires that a warning is provided on foods and beverages if the product exposes a consumer to any one of approximately 900 listed chemicals or heavy metals that the State has identified as known to cause cancer, birth defects, or other reproductive harms. The minimum levels of heavy metals like lead that trigger a Prop 65 warning are set at extremely low levels, but the warnings are intended to help California consumers make informed decisions about their exposures to listed chemicals and heavy metals in products. Because Athletic Coffee products may contain heavy metals that are included on the Prop 65 list, the warning above must be communicated to be Prop 65 compliant.  The warning may be familiar to anyone who has visited a restaurant, coffee shop, or take-out establishment in California.

Prop 65 Heavy Metals & Food

Tiny amounts of heavy metals are present in many foods and drinks. In 2014, the FDA published a five-year study(1) of heavy metals found in commonly bought grocery store items.  This study showed that heavy metals were prevalent in many of the food items tested, and like Athletic Coffee’s products, would require a Prop 65 warning similar to the one above.
